PROTECT YOUR LIEN RIGHTS!


Florida's Construction Lien Law Chapter 713 is one of the strongest in the country. Properly used, it can save you untold thousand's of dollars and also speed the turnover of your accounts receivables.
Subcontractors and material suppliers must serve a "Notice to Owner" before or within 45 days of first furnishing materials or service. If you fail to properly notify the owner of you presence on the property, you may forfeit your right to lien the property.
"Notice to Owner/Notice to Contractor" must be service by certified mail to the owner and anyone else designated by the "Notice of Commencement or Bond".
After a "Notice to Owner/Notice to Contractor" has been served (unless you are dealing directly with the owner, in which case you are not required to serve a notice) you have 90 days after last furnishing materials or service to file a "Claim of Lien or Notice of Nonpayment".
"Claim of Lien's or Notice of Nonpayment" are also served by certified mail to the owner and anyone else designated by the "Notice of Commencement or Bond".
In addition the "Claim of Lien" is recorded with the Clerk of the Circuit Court in the county in which the property is located.
